i've gotta take that chance mate, the woman that phoned me 2-day from a place that deals with bankruptcy said 4 me 2 sell the car or put it in some1 elses name
 
could realy be better to get it registered/owned outside the family name !

If thats what she has asked you to do then do it.
But your official receiver,after you go BR,will want to know everything,and don't hold back any info,they have some crazy assed power.
 
My ex went bust very recently, it's still all fresh in my mind.
If you want to keep your two cars, strip them out, so they can't be moved or look unattactive to the bayliffs. At least take the wheels off, remove the interior, make them look half-done.
She had a garage with a sh*t load of stock in (she owned a shop and 'recovered' most of the debt from selling off the stock - it's always for the best, there is a business on the other end that needs some money back) - one of my cars was in there and I took the wheels off and they weren't interested.

Don't be pushed into going through a 'special scheme' which is basically an IVA.

Can I ask you why you went bankrupt though? A couple of friends have chosen bankrupcy through personal reasons, ie. they had 8 credits cards and spent through pure greed. :(

the IVA ppl can't help cos i'm unemployed & i owe alot of money on a car that i had on finance in 2002 that fecked up on me & they would'nt fix it under the extra warranty cover that i took out so i told them 2 come get it after owning it only 6 months, i've paid £4000 off it already, should'nt i request the car back though? cos they sold it on
 
dave if your paying for the car they should of given it back or paid the loan off ???? btw if you want u can put it in my name bud i dont mind helppin told u that :P

hows that possible if they nolonger belong to him? thats against the law that in affect would be like the debt collecters coming 4 me but taking away my dads 307cc???? all u gotta do is put them aLL IN ur mom or dads names and make up u sold them they r no longer yours i did that with mine and the debt collecters never could do anything 2 my car when i got in the ****.

If you say you sold them they will wonder where the money is and why it wasn't used to pay off debts, when my mum went bankrupt a few years back, and she was unemployed, she said that her car was a gift from her dad hense the reason it was in his name and they couldnt touch it. She managed to do this with alot of her more valueable items, because they couldn't prove that she bought them she got away with saying they were on loan from friends and familly.

legally I dont think that your allowed to have any kind of credit for 7years after being declared bankrupt although my mum managed to get catolouges store and credit card after about 18months, but I'm in scotland and laws are slightly different up here.
 
one of my customers at work has been bankrupt 5 times now he is running his buissness properly and doing really well and all he done with his house etc was put it in his sons name ;) and just said he was livin there just goes to show really. Now DAVE give me the astra mate ;) i'l only borrow the skirts haha

These aren't debt collectors,they are government officials.
They can make you get the cars back,or they go and get them themselves.
Anything up to about 12 months before you go BR is scrutinised.
You get an automatic discharge after 12 months,some people get it sooner,depends on your situation.
After BR you tell the credit ref agencies,and then you start to build up your credit rating.
Whilst BR you cannot obtain more than £500 loan/credit.
 
just out the blue! if the car you had was anything to do with yees car credit,then head strait over to www.saynotoyes.co.uk.
its absolutely amazing the amount of laws been broken,dirty dealings,etc...
even if its some other company there is a hell of a lot of info on the site :thumb:
 
what if you sell the cars to pay off a debt you owe to your parents etc ;)
 
could just say you gave them to that person because you owe them money lol
 
I am bankrupt and have the exempt certificate to say i can keep my car,my bankruptcy only lasts 12 months
 
they have to be in someone else's name 6 months previous to your bankrupcy
 
well i've had abit of good news 2-day, i phoned the debt collection ppl on friday 2 request my agreement from when i purchased the car from the garage & they said they would phone me on monday 2 get some details & then send it 2 me. havent heard from them but my dad phoned them 2-day & some1 from there said it looks like some1 has fooked up somewhere, cut a long story short, i should'nt have paid them nearly £4000 for a car that i dont own, so i'm looking into this further now & hopefully get my money back or some of it :high5:
 
Explain that a bit more mate.
i've been paying 4 a car that i told the finance 2 come & collect which they did, but they still insisted that i paid the full amount 4 it even though they had taken it back & sold it on.
that any help lee? :beer:
